Please read these Terms and Conditions ("Terms") carefully before using this website (the "Service"), operated by Designers Prescription LLC ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By using this website you confirm that you have read and understood this agreement. If you do not agree, you must stop using the Service.
1. Conditions of use
By using this website you agree to use it only as permitted by law and in accordance with these Terms.
2. Privacy
Our Privacy Policy explains how we collect, use and protect your information. Please review it before using the Service.
3. Age restriction
You must be at least 18 years of age to use this website and to use our SMS service. By using the Service you represent that you are at least 18 years old and legally capable of entering into this agreement.
4. SMS Terms
By providing your mobile number on our appointment request form and ticking the SMS consent checkbox, you agree to receive transactional and service-related text messages from Designers Prescription LLC: a welcome message when you first opt in, and appointment confirmations, reminders and scheduling updates for appointments you book. We do not send marketing or promotional messages under this program. You must be 18 years of age or older to use this SMS service (see section 3). Message frequency varies based on your appointments. Message and data rates may apply. Reply HELP for help or STOP to cancel at any time. Carriers are not liable for delayed or undelivered messages. 5. Appointments and services
An appointment request submitted through this website is a request, not a confirmed booking, until we confirm it with you. Design proposals, quotes and timelines we provide are estimates based on the information you give us and may change if the scope changes. You agree that the information you provide when requesting an appointment is accurate and current so that we can reach you.
6. Intellectual property
All materials on this website, including copyrights, trademarks and proprietary content, are the property of Designers Prescription LLC and its licensors. You agree not to reproduce, redistribute or exploit them without express written permission.
You retain ownership of materials you supply to us. By supplying them, you grant us the licence necessary to perform the services you engage us for, and you confirm that you have the right to use those materials and that they do not infringe the rights of any third party. Ownership of finished design work is governed by the individual service agreement for your project.
7. Links to other websites
The Service may contain links to third-party websites we do not own or control. We are not responsible for their content, policies or practices, and we encourage you to review the terms and privacy policies of any third-party site you visit.
8. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of liability
Designers Prescription LLC shall not be liable for any damages arising from your misuse of this website or the Service, or from carrier delivery failures or delays in the SMS program described in section 4.
10. Indemnification
You agree to indemnify and hold harmless Designers Prescription LLC and its affiliates against any claims, damages, liabilities and expenses arising from your use or misuse of the Service.
11. Governing law
These Terms are governed by the laws of the State of Nevada, United States, without regard to conflict of law provisions. Any dispute shall be submitted to the exclusive jurisdiction of the state or federal courts located in Las Vegas, Nevada.
12. Changes to these Terms
We may update or modify these Terms at any time. If revisions are material we will provide notice at least 30 days before they take effect. By continuing to use the Service after changes take effect, you agree to the updated Terms.
13. Entire agreement
These Terms constitute the entire agreement between you and Designers Prescription LLC regarding use of the Service and supersede all prior agreements.
